We at Syzigy, Inc. (“Syzigy,” “we,” “us,” or “our”) have created this privacy policy (this “Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to our information collection and use practices in connection with our App, which is accessible through tablets, smart phones, and other devices (“App”), and when you interact with us in any other way.
By clicking “I AGREE,” or otherwise manifesting your assent to the Privacy Policy and accompanying Terms of Use, when you sign up to access and use the App, you acknowledge that you have read, understood and agree to be legally bound by the terms of this Privacy Policy and the accompanying Terms of Use.
Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.
The Information We Collect and/or Receive
In the course of operating the App, and/or interacting with you, we will collect (and/or receive) the following types of information. You authorize us to collect and/or receive such information.
Contact Information. When you contact us via email or in any other manner, or when you call us, you will be asked to provide certain information, such as your name, email address, and information regarding your inquiry or request (collectively, the “Contact Information”). The Contact Information is used to provide the requested service or information and to contact you for purposes of direct marketing of our current and future products and services.
Account Information. In order to access and use the App, you will have to create an account by providing your name, email address (optional), date of birth, and phone number (collectively, the “Account Information”). We use your Account Information to create and administer your account, including verifying your identity and managing account access. If you provide your email address, we may also use it to send marketing communications, manage waitlist registrations, and deliver access or verification codes.
Profile Information. During the onboarding process and through your use of the App, you may provide information to create your profile. Such information may include, but shall not be limited to, your name, date of birth, city, profile photo, supplementary profile images, and your selected Spheres and interests (such as topics, events, or places) (collectively, the “Profile Information”).
Location Data. During the onboarding process, you will be asked to manually enter your city. We do not request GPS location permissions at this time. Your city is incorporated into your public profile and may be used to suggest locally relevant Spheres, Threads, and Circles. We may enable GPS-based location services in the future, at which point we will update this Privacy Policy and, where required, seek your consent.
User-Generated Content. You may post and/or upload User-Generated Content through the App, including messages within Circles, Thread contributions, and other content shared on the App. We use User-Generated Content in accordance with our Terms of Use. Any personal information contained in the User-Generated Content will be used in accordance with this Privacy Policy.
Contacts Access. You may optionally grant the App access to your device contacts. If you do, we use this data to display mutual connections on the feed and on user profiles, and to prioritize suggestions based on the number of mutual contacts. This data is not shared with or visible to any third parties or other users. You may revoke contacts access at any time through your device settings.
Circle Data. We maintain records of Circle membership composition, group chat history, and social connections formed on the App. Circle membership lists are accessible to current Circle members and users viewing a Circle through the feed. When you visit another user’s profile, you can see only the Circles you have in common. Chat message history within a Circle is accessible only to participants of that Circle and is also used as context for our AI features, including Moments (described below). However, for open Circles only, we may display one or two messages from the most recent, active thread in the feed for the purpose of helping users discover Circles and evaluate whether to join. Any such messages will be clearly identified in the feed, and users will be informed that the content is visible to non-members for discovery purposes. Messages from private Circles or older threads are never shown to non-members. In addition, thread titles and starter messages may be featured on the public feed to facilitate content discovery; however, actual chat messages within a Circle are never exposed to non-members. When you establish friendships on the App, we use that data to prioritize Circle recommendations, and other users viewing your profile may see your connection status and shared mutual friends.
AI-Generated Moments. We use artificial intelligence to generate images and other mementos intended to reflect or capture aspects of a Circle’s shared conversational experience (“Moments”). Moments may include or feature AI-generated representations of users derived from their profile information, such as profile photos. AI-generated content is illustrative in nature and may not accurately represent any individual’s appearance, identity, or experiences. We store Moments for purposes related to operating, maintaining, improving and supporting the App, including record-keeping and feature functionality. Moments are featured on the public feed for a set duration (presently seven (7) days, subject to adjustment) and are permanently stored on the Circle Journey page of the originating Circle. During the initial seven-day window, Moments are discoverable by the entire App community on the feed. After this period, access to a Moment is generally limited to members of the Circle in which the Moment was created and may continue to be displayed within Circle-specific areas of the App. You may choose to share Moments externally through third-party platforms or services (such as social media platforms). If you do so, your interaction with those third-party services and any resulting disclosures are governed by their respective terms and privacy policies, and Syzigy is not responsible for how such third parties use or process that content.
Information collected and/or received through the Chat interface on our App. We partner with a third-party vendor (CometChat) to provide you with the Chat interface on our App. In connection with providing chat services, CometChat processes and stores certain information on our behalf, including internal user ID, first name, profile photo, full chat history, and Circle/Group membership information. CometChat acts as a service provider and processes this information solely for the purpose of enabling chat functionality and supporting the operation of the Chat interface, in accordance with our instructions and applicable contractual and legal requirements, for purposes related to operating, maintaining, and supporting the App’s chat functionality. We may modify or replace our chat service providers from time to time as the App evolves. For more information about CometChat, please visit: https://www.cometchat.com/.
Information obtained from other sources. SMS Messages: You may elect to receive SMS text messages from us in connection with the App, including for account verification, authentication, and service-related communications, as well as notifications related to your use of the App. These messages may be triggered by actions you take within the App, including SMS-based verification or security checks. If you opt in to receive SMS messages, we will collect and store the information you provide, such as your mobile phone number, and may record delivery and read confirmations where available. By opting-in to receive SMS messages from us, you acknowledge that messaging and data rates may apply depending on your phone service provider. You may opt out of receiving SMS messages at any time by texting “STOP” in response to a SMS message you receive or by adjusting your notification and communication preferences within the App. However, opting-out of SMS messages may limit your ability to access and use certain features of the App, including SMS-based account verification or security functionality.
Information obtained automatically from your online activity. When you access or use the App, we use cookies, pixels, device identifiers, local storage technologies, and similar technologies (collectively, “Tracking Technologies”) to automatically collect or receive certain standard technical information and other data (such as traffic data, usage data (including, but not limited to, features used, frequency and duration of App usage, and interactions with content on the App), location data (where you have enabled location services), device information (including, but not limited to, type of device, mobile device platform, operating system and version, unique device identifiers, screen resolution, IP address and other technical information), logs and other communications data) sent to us by your mobile device, or any other device over time via our App. We may also evaluate your device to identify any malicious software or activity that may affect the availability of our App.
When you access or use the App, analytics providers and other third parties may use Tracking Technologies to collect information about your online activities over time and across different apps, online services, and devices.
The data we or third parties collect automatically may include personal information and/or statistical data that may not identify you personally; however, we or third parties may maintain, combine, or associate it with personal information collected in other ways or received from third parties. We and/or third parties use this information to (i) enhance the performance and functionality of our App; (ii) personalize your experience with the App, understand how you use our App, maintain a persistent session, and improve and further develop our App; and (iii) provide custom experiences and for analytics purposes.
The Tracking Technologies used on the App include the following, among others:
Cookies: Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. In addition to collecting information, we use cookies to help us authenticate users, provide content of interest to you, analyze which features you use most frequently, and measure and optimize advertising and promotional effectiveness. To do this, we may use both session cookies, which expire once you close your web browser, and persistent cookies, which stay on your computer until you delete them. For information regarding your choices regarding Cookies, please see Section IV of this Privacy Policy.
Device Identifiers: We may collect and use device identifiers, such as the Identifier for Advertisers (IDFA) or Identifier for Vendors (IDFV), to recognize your device, understand how you use our App, and deliver relevant content. Consistent with Apple’s App Tracking Transparency framework, we will request your permission before collecting information used to track you across apps and websites owned by other companies.
Local Storage Technologies: We may use local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
Information Collected Through the App that is Not Covered by this Privacy Policy
You may voluntarily post and share information including, but not limited to messages, Thread contributions, and experiences through various features available from time to time through the App. None of the information you provide through the use of these features is protected by this Privacy Policy including any personal information.
THIS PRIVACY POLICY DOES NOT APPLY TO ANY INFORMATION (INCLUDING PERSONAL INFORMATION) THAT YOU PROVIDE USING ANY SUCH FEATURES. ALL SUCH INFORMATION IS PUBLIC INFORMATION AND MAY BE VIEWED, COLLECTED, USED, MODIFIED AND/OR DISCLOSED FOR ANY PURPOSE BY SYZIGY, AND ANY USER OF THE APP.
How We Use and Share the Information
In addition to the uses of information described elsewhere in this Privacy Policy, we may also use and share your personal information as set forth below:
- To provide the App and customize the content you see on the App;
- To solicit your feedback, inform you about our products and services and those of our third-party marketing partners;
- To monitor, support, analyze, and improve the App;
- To communicate with you regarding the App;
- To fulfill your requests for information regarding new or improved products and services;
- To engage in marketing, advertising, and tracking activities, and evaluate the efficacy of our efforts, provided that, where required under applicable law, we will obtain your prior opt-in consent to send electronic marketing communications and/or our newsletter;
- To engage in research, project planning, troubleshooting problems, and detecting and protecting against error, fraud, or other criminal activity;
- To protect the safety and security of our App, businesses and customers;
- To third-party contractors and service providers that provide services to us in the operation of our business and assistance with the App, such as technical support for our App and providing services such as marketing and advertising companies, consulting service organizations, IT and cloud service providers, among others;
- Certain features and functionality of the App are powered by artificial intelligence and machine learning technologies provided by third-party AI model providers. To enable these features, we may share limited personal data submitted through the App with such providers, who process the data solely on our behalf and in accordance with our instructions to provide the requested services. These third-party AI providers are contractually prohibited from using personal data to train, improve, or develop their own models or for any purpose other than providing services to us.
- To create and disclose aggregated, anonymous, user statistics and other information to (i) affiliates, agents, business partners, and other third parties; (ii) describe the App to current and prospective business partners; and (iii) other third parties for lawful purposes;
- To share some or all of your information with our parent company, subsidiaries, affiliates or other companies under common control with us;
- To fulfill our legal and regulatory requirements;
- To comply with applicable law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- To assess or complete a corporate sale, merger, reorganization, sale of assets, dissolution, investment, or similar corporate event where we expect that your personal information will be part of the transferred assets;
- To audit our internal processes for compliance with legal and contractual requirements or our internal policies;
- To prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft; and
- Otherwise, with your consent.
We will take reasonable measures (e.g., by contract) to require that any party receiving any of your personal information from us, including for purposes of providing the App, undertakes to: (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your personal information except with your consent, as permitted by applicable law, or as permitted by this Privacy Policy; and (iii) generally protect the privacy of your personal information.
Your Choices
Update Information: If the personal information we have for you changes, you may correct, update, or delete it by contacting us as set forth in Section XII of this Privacy Policy. You may correct, update, or delete some of your personal information directly in your account on the App. We will use commercially reasonable efforts to process all such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases. Additionally, we will retain and use your information (or copies thereof) as necessary to comply with our legal and/or regulatory obligations, resolve disputes, and enforce our agreements.
Marketing Communications: You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing emails. Please note that you cannot opt out of receiving transactional e-mails.
Cookie Management: Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change their settings. Please note that if you set your browser to disable cookies or other Tracking Technologies, the App may not work properly. For more information about cookies, including how to see what cookies have been set on your browser and how to manage and delete them, visit www.allaboutcookies.org.
You will need to apply these opt-out settings on each device from which you wish to opt-out. We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above.
How We Protect the Information
We take commercially reasonable steps to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.
External Sites
The App may also contain hyperlinks to other third-party websites or apps (“External Websites”). We have no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or External Websites to which we provide hyperlinks. As such, we are not responsible for the content or the privacy policies of those External Websites. You should check the applicable third-party privacy policy and terms of use when visiting any External Websites.
Children’s Information
Our App is not directed to children under the age of 18, and you must confirm that you are 18 years or older in order to create an account and use our App. We do not knowingly collect personal information from children under the age of 18 through the App. If you are under 18, please do not give us any personal information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information through the App without their permission. If you have reason to believe that a child under the age of 18 has provided personal information to us, please contact us, and we will endeavor to delete that information from our databases.
Important Notice to Non-U.S. Residents
The App and its servers are operated in the United States. If you are located outside of the United States, please be aware that your information, including your personal information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your country of origin. If you are located outside the United States and choose to use the App, you consent to any transfer and processing of your personal information in accordance with this Privacy Policy, and you do so at your own risk.
Do Not Track
As described above, third parties such as analytics providers may automatically collect information about your online activities over time and across different online services when you access or use the App. Some web browsers and devices offer a “Do Not Track” (“DNT”) preference or similar signals intended to provide users with control over online tracking. However, there is currently no industry-wide or legal standard for recognizing or responding to these signals. As a result, at this time, we do not monitor, recognize, or respond to “Do Not Track” signals or other similar opt-out mechanisms, including signals transmitted by web browsers, mobile operating systems, or other device settings.
Notice to California Residents
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. Changes to This Privacy Policy
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time with or without notice to you. Any such changes will be posted on the App. By accessing and/or using the App after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of your information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
